The App offers a 3-day free trial period for new subscribers. If you do not cancel the subscription at least 24 hours before the end of the free trial period, you will be charged the subscription fee.

1.3 Subscription Management

1.4 Payment

Payment will be charged to your Apple ID account upon confirmation of purchase. The subscription will renew at the same price unless otherwise specified.

2. User Conduct

2.1 Prohibited Uses

You agree not to:

- Use the App for any illegal or unauthorized purpose.

- Modify, adapt, hack, or reverse engineer the App.

- Use the App to transmit any viruses or malicious code.

- Use the App in a way that could interfere with, disrupt, or negatively affect other users.

2.2 Content Ownership

All content generated or provided by the App is owned by the App and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the content for personal, non-commercial use.

3. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, if you violate these Terms or engage in any prohibited conduct.

4. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.

5. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use of the App.

- Any unauthorized access to or use of our servers.

- Any bugs, viruses, or the like transmitted to or through the App.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is based, without regard to its conflict of law principles.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after such changes will constitute your acceptance of the new Terms.

9. Apple Specific Terms

9.1 Acknowledgement

Both you and we acknowledge that this Privacy Policy is concluded between you and us only, and not with Apple, and that we, not Apple, are responsible for the App and its content. The Privacy Policy must not provide for usage rules for the App that are in conflict with the App Store Terms of Service as of the Effective Date (which you acknowledge you have had the opportunity to review).

9.2 Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service, except that such licensed App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

9.3 Maintenance and Support

We are solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms, or as required under applicable law. Both you and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

9.4 Warranty

We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

9.5 Product Claims

We, not Apple, are responsible for addressing any claims of yours or any third party relating to the App or your possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App’s use of the HealthKit and HomeKit frameworks.

9.6 Intellectual Property Rights

Both you and we acknowledge that, in the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9.9 Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App.

9.10 Third-Party Beneficiary

Both you and we acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
